Facts
Each session of the Nebraska legislature begins with a prayer given by a chaplain. The chaplain is paid for his services out of public funds. Ernest Chambers (plaintiff), a member of the Nebraska Legislature and a taxpayer of Nebraska, challenged the practice of legislative prayer on the ground that it violated the Establishment Clause of the First Amendment.
