New York Supreme Court, Appellate Division
875 N.Y.S.2d 925 (2009)

Facts
An applicant to the New York bar (plaintiff) passed the state bar exam and was certified for admission, pending approval from the Committee on Character and Fitness (committee). The applicant disclosed to the committee that he had taken out multiple student loans over a 20-year period and that he was delinquent on $430,000 of loans. The committee reviewed the evidence and interviewed the applicant. The applicant claimed that he sincerely intended to repay the loans. However, the applicant had never made a significant payment on any of the loans. In addition, the evidence showed that the applicant had been inflexible during discussions with the loan servicers. The committee considered whether the applicant had the character and general fitness to become a member of the bar and practice law.
