Facts
Christopher Ross (plaintiff) and Danielle Ross (defendant) were married for several years before Danielle filed for divorce. In her petition, Danielle cited fault and irreconcilable differences as the reasons for the requested divorce. Christopher cross-filed for divorce, citing Danielle’s alleged adultery. Christopher claimed he was entitled to more than half the marital estate. Eleven months into the divorce proceedings, Christopher allegedly began a sexual relationship with another woman. Danielle filed a motion to dismiss, citing recrimination. The trial court sided with Danielle and eventually entered a divorce decree on the grounds of irreconcilable differences. Christopher appealed the trial court’s dismissal of his request for a fault-based divorce. Specifically, Christopher argued that the court could not consider his conduct after the divorce proceedings began in determining the grounds for the divorce.
