Facts
In 2003, Wasim Khan (plaintiff) bought a townhouse in a community that was managed by Mazdabrook Commons Homeowners’ Association (association) (defendant). Upon purchase, Khan signed a document that informed him that he must comply with an association rule that prohibited posting signs on the property, except for-sale signs. Khan ran for Parsippany Town Council in 2005 and placed two campaign signs on the inside of a window and door to his townhouse. The association notified Khan that his campaign signs violated the rules, assessed a $25 fee, and ordered their removal. Khan complied and removed the signs.
