Facts
Lucille McCabe (plaintiff) was injured when the airbag in her Honda Civic did not deploy during a head-on collision with a Cadillac traveling at high speed. McCabe sued American Honda Motor Company (Honda) (defendant), alleging the airbag was defective in both manufacture and design. Honda provided the expert declaration of an engineer who reconstructed the accident and determined that the airbag performed as designed. McCabe testified that she expected the airbag would deploy, and she presented pictures of the damage and eyewitness testimony to the high speed of the Cadillac. However, McCabe did not provide expert testimony to contradict Honda’s engineer. The trial court granted Honda’s motion for summary judgment, which argued the airbag performed as intended. McCabe appealed.
