Facts
McCurdy (plaintiff) purchased a boat manufactured by Texar, Inc. (Texar) (defendant). McCurdy sued Texar under the Magnuson-Moss Warranty Act, 15 U.S.C. § 2310(d), alleging that the boat was defective. However, no written warranties accompanied the boat. The trial court held that the Magnuson-Moss Act was unavailable to McCurdy because the Magnuson-Moss Act only applied if written warranties existed and did not extend to implied warranties. McCurdy appealed.
