Debra McGee (plaintiff) and Justin Gonyo (defendant) signed a Voluntary Acknowledgement of Parentage (VAP) stating that they were the child’s biological parents. However, the parties knew that Gonyo was not the biological father. The Office of Child Support (plaintiff) moved for child support and genetic testing despite the VAP. Gonyo opposed the motion and moved to establish his parentage of the child. The family court found that Gonyo lacked standing to bring a parentage claim because he was not the biological father. The family court also set aside the VAP as a fraud perpetrated on the court. Gonyo appealed.
