Facts
In August 2012, Dockendorf (plaintiff) proposed to McGrath (defendant) with a two-carat engagement ring. In September 2013, Dockendorf broke off the engagement and later filed an action in detinue seeking the return of the ring. At trial, McGrath argued Virginia Code Section 8.01-220 barred Dockendorf’s suit. The trial court held that Virginia Code Section 8.01-220 did not bar an action in detinue for recovery of the engagement ring and ordered McGrath to return the ring. McGrath appealed to the Virginia Supreme Court.
