Facts
Dr. Glen Aasheim (defendant) performed a tubal ligation on Karen McKernan that didn’t take. She got pregnant and gave birth to a healthy baby. She and her husband (plaintiffs) sued Aasheim for negligence, seeking damages that included the costs of raising a child and providing a college education. Aasheim won a partial summary judgment dismissing the request for those expenses. The appellate court affirmed, prompting the McKernans to appeal further to the Washington Supreme Court.
