Facts
Same-sex couple Kimberly (plaintiff) and Suzan McLaughlin (defendant) legally married and had a child together, using artificial insemination and an anonymous sperm donor to impregnate Kimberly. Kimberly worked while Suzan stayed home with the baby. When the baby was almost two, Kimberly moved out with the baby and cut off Suzan’s contact with him. Suzan filed for divorce and parenting rights, challenging the constitutionality of the Arizona statute that afforded only males married to a baby’s mother a presumption of parentage. The trial court ruled in Suzan’s favor, and Kimberly appealed.
