Facts
Freedom Newspapers, Inc. (defendant) published a photograph of high-school soccer player Larry McNamara (plaintiff) without anyone realizing the photograph showed his genitals. McNamara was running full stride after a soccer ball, evidently not wearing the customary athletic supporter. McNamara sued the newspaper, alleging it invaded his privacy by publication of true, private facts, and that it could have used one of many other photographs taken. The trial court entered judgment for the newspaper and McNamara appealed.
