Medina Rene v. MGM Grand Hotel, Inc.
United States Court of Appeals for the Ninth Circuit
305 F.3d 1061 (2002)
- Written by Haley Gintis, JD
Facts
In 1993 the MCM Grand Hotel (the hotel) (defendant) hired Medina Rene (plaintiff) to work as a butler. Rene was subjected to daily harassment by his coworkers and supervisors. Rene alleged that the other employees whistled and blew kisses at him, called him names, touched his body in a sexual manner by grabbing his genitals and sticking their fingers in his anus, and forced him to look at pictures containing male nudity. Rene believed that he was subjected to such treatment because he was openly gay. Rene filed a Title VII hostile-work-environment claim in federal district court against the hotel based on the sexual touching he endured. The hotel moved for summary judgment on the ground that Rene had not established a prima facie hostile-work-environment claim. The district court granted the hotel summary judgment on the ground that Rene believed the inappropriate conduct was because he was gay rather than because of sex. Rene appealed.
