Facts
During his marriage to Kathryn Metz (plaintiff), Albert Metz (defendant) purchased a disability-insurance policy and was injured. Consequently, Albert became entitled to a monthly disability payment through the age of 65. Later, Kathryn filed for divorce. The trial court deemed Albert’s past and future disability payments marital property and awarded a portion to Kathryn. Albert appealed, asserting that disability payments received after the divorce should not be considered marital property. The Wyoming Supreme Court granted certiorari.
