Facts
Jose Molinelli-Freytes (plaintiff) alleged that the University of Puerto Rico (university) (defendant) infringed his copyright in a manuscript that he created during nonworking hours while employed as a professor at the university. The university argued that Molinelli-Freytes did not own the copyright in the manuscript because it was a work for hire. Molinelli-Freytes filed a motion for preliminary injunction, which the district court denied. However, the court also noted that a question of law remained as to whether there was a teacher exception to the work-for-hire doctrine. The court ordered further briefing of the matter for the purpose of narrowing the issues for trial.
