Facts
Vicky Moss (plaintiff) filed for divorce from her husband of 31 years, Clay Moss (defendant). At trial, Vicky gave testimony concerning Clay’s habitual belittlement and humiliation of her. This conduct included constant attempts by Clay to control what Vicky wore, verbally abusive criticism of her performance of household tasks, and accusations of infidelity. Vicky testified that she developed depression and anxiety as a result. The chancery court granted a divorce on the grounds of habitual cruelty and inhuman treatment (also known as cruel and inhumane treatment). Clay appealed, arguing that Vicky failed to meet the burden of proof.
