Facts
Therapist Nancy Baird (defendant) caused Thomas Mower’s (plaintiff) four-year-old daughter to falsely remember that Mower had sexually abused her. Mower sued Baird for mental-anguish damages arising from his daughter’s false accusation of sexual abuse. The trial court dismissed Mower’s claim, reasoning that Baird did not owe Mower a duty of care because Mower was not her patient. Mower appealed.
