Facts
Wanda Murff (plaintiff) was married to John Murff (defendant) for over 20 years. Although both parties were employed during the marriage, Wanda’s salary was significantly less than John’s. Wanda filed for a divorce from John based in part on John’s adultery and cruel treatment. The trial court granted the divorce and awarded Wanda a greater distribution of the community-property estate based on John’s fault and the disparity of the spouses’ incomes. John appealed, and the Texas Court of Civil Appeals reversed, holding that the trial court improperly considered the fault of the parties and the disparity of their incomes in the community-property distribution. Wanda appealed.
