Facts
Gregory Murphy and Mary Murphy entered a separation agreement stipulating the payment of alimony and child support of $462 per week. The agreement was incorporated into the ensuing divorce decree. Gregory later found that his income was less than anticipated at the time of the separation agreement. He petitioned the Delaware Family Court to modify its order with the hope of reducing the weekly alimony and child support to $250. Mary expressed a willingness to compromise at $350 per week. Gregory then requested that the court modify the separation agreement itself. Mary countered that the agreement was a contract that was not subject to later modification by the court.
