Facts
Physician George David (defendant) had an affair with Dixie West, the wife of Tofigh Mussivand (plaintiff). Mussivand sued David in an Ohio court, claiming that David had transferred a sexually transmitted disease (STD) to Mussivand through West. Mussivand alleged that David was negligent in failing to inform West of the STD or to otherwise prevent its transmission. The trial court granted David’s motion to dismiss on the ground that he did not owe a duty of care to Mussivand. An appellate court reversed. David appealed.
