Facts
An employee of Herndon Ambulance Service, Inc. (Herndon) (defendant) allegedly raped Ruth Ann Nazareth (plaintiff) as she was being transported by ambulance to a hospital. Nazareth sued Herndon for damages. The trial court found that there were no valid reasons to hold Herndon vicariously liable for its employee’s wrongdoing and granted summary judgment for Herndon. Nazareth appealed to the Florida Court of Appeal.
