Neudecker v. Neudecker
Indiana Supreme Court
577 N.E.2d 960 (1991)
Facts
The marriage between Wendy Neudecker and Rolland Neudecker was dissolved. In the resulting decree, Wendy was awarded custody of the couple’s two children, and Rolland was ordered to pay the four-year college expenses of the older child. Rolland appealed, arguing that the section of the child-support statute enabling courts to order divorced parents to pay for their children’s education was unconstitutionally vague. The court of appeals affirmed. Rolland appealed. The Indiana Supreme Court granted certiorari.
