Facts
Prior to 1997, certain transfers of assets or trusts immediately preceding a Medicaid application would delay eligibility for Medicaid. In 1997, Congress made it a crime for anyone to counsel or assist persons in such transfers or any asset disposition to qualify for Medicaid. The New York State Bar Association (NYSBA) (plaintiff) sued the federal government (defendant), claiming that this new law violated the First Amendment. The NYSBA moved for a preliminary injunction. After the motion was filed, Attorney General Janet Reno stated that the federal government would not enforce the new law.
