Facts
R.R. Beaufort & Associates, Inc. (Beaufort) (defendant) built a home in 1983. The home was then sold to Beaufort’s cousin, Debra Cronin. A few months after purchasing the home, Cronin noticed large cracks in the garage floor. Beaufort poured a new garage floor that year. In 1985, Cronin sold the home to Nichols (plaintiff). Nichols built an addition onto the home that year. In 1988, the garage floor caved in. In 1991, cracks developed in the walls of the addition, kitchen, and garage. Nichols hired an engineering firm to investigate. The engineering firm discovered that Beaufort had constructed the home’s foundation on unstable soil containing voids and organic materials that had decomposed over time, which caused walls in the home to crack and the garage floor to collapse. Nichols sued Beaufort, alleging negligent construction and breach of implied warranties.
