Facts
Nintendo of America, Inc. (plaintiff) posted a $15 million bond when it requested that Lewis Galoob Toys, Inc. (defendant) be enjoined from selling the Game Genie. Nintendo claimed the Game Genie infringed on Nintendo’s copyrights. The district court enjoined Galoob. After trial, the district court ruled that Galoob was wrongfully enjoined and determined that the damages Galoob suffered due to the injunction were more than the $15 million bond. Consequently, the district court awarded Galoob the entire amount of the bond. Nintendo appealed to the United States Court of Appeals for the Ninth Circuit.
