Facts
Oatly AB (plaintiff) applied with the European Union Intellectual Property Office (EUIPO) (defendant) to register the phrase “It’s like milk but made for humans” for milk-substitute products. The EUIPO denied the application on the ground that the phrase was a promotional slogan that failed to display the distinctive character necessary to identify Oatly, as opposed to other companies, as the origin of the products. Oatly appealed. The EUIPO board of appeals affirmed the rejection. The case then came before the European General Court.
