Office Depot Inc. v. Zuccarini
United States Court of Appeals for the Ninth Circuit
596 F.3d 696 (2010)
- Written by Tammy Boggs, JD
Facts
In 2000, Office Depot Inc. (plaintiff) obtained a judgment against John Zuccarini (defendant) under the Anticybersquatting Consumer Protection Act (ACPA) based on Zuccarini’s registration of the domain name offic-depot.com. Office Depot assigned its judgment to DS Holdings (DSH) (plaintiff) for collection. Zuccarini owned other domain names that were maintained in a VeriSign registry. VeriSign was the registry for .com and .net domain names and had its corporate headquarters in Mountain View, California, within the judicial district of the Northern District of California. DSH sought to levy Zuccarini’s domain names in the Northern District of California. The district court appointed a receiver to sell the .com domain names and use the proceeds to satisfy DSH’s judgment. Zuccarini appealed, challenging the propriety of levying his domain names in the Northern District of California.
