Facts
Charles E. Olson, a minor and skateboard user, was seriously injured in the Village of Oak Lawn (defendant) when his skateboard hit a displaced slab of public sidewalk and he was sling-shotted and fell. Olson’s mother (plaintiff) sued the village on his behalf and alleged that the municipality negligently maintained the public sidewalk upon which her son was injured. The village moved for summary judgment and denied that its duty to maintain its sidewalks applied to skateboard users. The trial court agreed and entered summary judgment for the village. Olson’s mother appealed.
