Facts
Gloria Osorno (defendant) and Henry Osorno (plaintiff) met after Gloria turned 40 years old, and Gloria soon became pregnant. Henry wanted her to have an abortion, but Gloria refused and instead wanted to get married. Henry agreed to marry Gloria if she signed a premarital agreement. Not wanting to be 40, pregnant, and unmarried, Gloria agreed to sign the premarital agreement, and Henry and Gloria were married the next day. Several years later, Henry filed for divorce. Gloria argued that the premarital agreement was unenforceable because she signed it under duress. The trial court found the agreement enforceable. Gloria appealed.
