Facts
Ellerbe Becket Architects & Engineers, P.C. and its parent company, Ellerbe Becket, Inc. (collectively, Ellerbe) (defendants) designed the MCI Center, an arena that was being built in Washington, D.C. The Paralyzed Veterans of America (plaintiff) filed suit against Ellerbe in federal district court, claiming that the design and construction of the MCI Center violated the Americans with Disabilities Act (ADA). Ellerbe moved to dismiss, arguing that the ADA did not hold architects liable for the design and construction of facilities in violation of the ADA’s provisions.
