Facts
Hitz (defendant) owned a poultry company in a district that housed several similar businesses. The path from the sidewalk to the business was sloped and required regular cleaning due to chicken manure and dirt. Paubel (plaintiff), a mailman whose route had served Hitz’s poultry business for years, was injured when he slipped and fell on the pathway while the pathway was dirty. Paubel filed suit and was awarded damages of $22,500 by the jury. Hitz appealed. The Missouri Supreme Court granted certiorari.
