Facts
Loretta Ray hired Ronald Griesheimer (defendant) as her attorney in her divorce case against George Ray. In the divorce decree, George was ordered to maintain their children as the prime beneficiaries of his life-insurance policies. Griesheimer did not inform George’s employer and insurance company of the court order. George remarried and changed the beneficiary of a life-insurance policy through his employer to his new wife. George died, and his wife collected on the life-insurance policy. Thomas Pelham (plaintiff), one of Loretta and George’s children, filed a malpractice case against Ronald claiming that he had breached his duty by not informing George’s employer and insurance company of the court order. The trial court dismissed Pelham’s complaint, and Pelham appealed.
