Doughney (defendant) registered the domain name peta.org. Doughney had no connection to People for the Ethical Treatment of Animals (PETA) (defendant), which had a registered trademark for “PETA.” During the registration process Doughney made false statements to assist him in obtaining the registration. After registering the domain name, Doughney made statements recommending that PETA “make him an offer” or “settle” with him to get access to the domain name. PETA brought suit under the Anticybersquatting Consumer Protection Act (ACPA). The district court found in favor of PETA and ordered Doughney to transfer the domain name peta.org to PETA. Doughney appealed.
