Facts
Willie McGee (defendant) and Lionel Edwards were involved in a scheme with several others to bribe police officers to aid them in their gambling operations. McGee was charged with conspiracy and bribery in the second degree. The evidence at trial showed that McGee agreed with Edwards’s goal of bribing the officers but that only Edwards made the bribery payments. The trial court instructed the jury that McGee could be convicted of the substantive offense of bribery based solely on the acts of his coconspirators. McGee was convicted of conspiracy and bribery. The appellate division affirmed. McGee appealed.
