Peterson v. Peterson
South Dakota Supreme Court
434 N.W.2d 732 (1989)
- Written by Craig Conway, LLM
Facts
Janey Peterson (plaintiff) was divorced from Gregory Peterson (defendant) after approximately 18 years of marriage. The trial court ordered Gregory to pay Janey $1,000 per month in spousal support for seven years and then $500 per month for an additional 10 years, unless Janey died or remarried during that period of time. In the event of Janey’s death or remarriage, the support would cease. Upon Janey’s marriage to another man within seven years, Gregory petitioned the trial court to amend the divorce judgment and extinguish Gregory’s duty to provide alimony. The trial court granted Gregory’s motion. Janey appealed.
