Facts
Mr. Pohlmann (plaintiff) was obligated to pay child support after he and his wife (defendant) divorced. Later, both remarried, and Mr. Pohlmann had three children with his second wife. He petitioned the court for a reduction in his child support obligations based on changed circumstances. A Florida statute provided that subsequent children could be considered where a party sought an increase in child support but not a reduction. The trial court denied Mr. Pohlmann’s petition, and he appealed, challenging the constitutionality of the Florida law.
