Polacheck v. Polacheck
Ohio Court of Appeals
5 N.E.3d 1088 (2013)
- Written by Rose VanHofwegen, JD
Facts
David Polacheck (plaintiff) earned six-figure salaries while his wife Amy (defendant) stayed home with their children. Amy incurred $40,000 in student-loan debt for nursing school. David divorced Amy shortly after she obtained her nursing degree and a $58,000 salaried job. The couple agreed that the student loan was marital debt but disputed how it should be divided. The trial court allocated the entire student-loan debt to Amy without any offsetting property division, reasoning that Amy alone would benefit from her degree. Amy appealed.
