Facts
Jessica Port (plaintiff) and Virginia Cowan (defendant) were married in California and later moved to Maryland. Two years later, Port filed a petition for divorce from Cowan on the ground of voluntary separation. The trial court denied Port’s petition and held that the California marriage was not valid in Maryland, because the marriage was contrary to public policy. Both Port and Cowan filed separate appeals, asking why a valid out-of-state, same-sex marriage was not recognized in Maryland on the basis of comity.
