R. v. Bury
England and Wales Court of Appeal
New York Law Journal, November 3, 1976, pp. 16-17
- Written by Jennifer Flinn, JD
Facts
A criminal defendant was convicted of three counts of indecent assault and two counts of indecency with a child. The defendant, along with several other adults, accompanied 14 children from a group home on an overnight trip. During the trip, three separate boys shared a bed with the defendant. The boys did not make any allegations against the defendant during the trip. Six weeks after the trip, another child overheard the three victims talking about the assault and reported it. At trial, only one boy gave testimony under oath, though his testimony contained inconsistencies. The defendant appealed from his conviction.
