Facts
Rehabilitation Association of Virginia (the association) (defendant) sued Bruce Kozlowski (plaintiff), the director of Virginia’s Department of Medical Assistance Services, and Donna Shalala (the secretary) (plaintiff), the secretary of the United States Department of Health and Human Services, challenging the amount Virginia contributed from state Medicaid funds toward expenses incurred by persons dually covered by Medicaid and Medicare, known as qualified Medicare beneficiaries (QMBs). For QMBs, Medicare covered 80 percent of reasonable charges for Medicare Part B-eligible medical services; the association’s suit concerned whether the state was responsible for covering the remaining 20 percent. The association argued that the buy-in provisions of the Social Security Act required Virginia to cover at least a portion of that 20 percent for QMBs. The secretary and Kozlowski challenged, arguing that Virginia was not required to contribute anything. The district court ruled in favor of the association, and the secretary and Kozlowski appealed.
