Facts
Richard (plaintiff) bought a house from A. Waldman and Sons, Inc. (Waldman) (defendant), a real estate developer. At the time of the purchase, Waldman gave Richard a plot plan showing a 20-foot sideyard, which Richard relied on to make his purchase. About four months later, Waldman discovered that the foundation of the house was only 1.8 feet from the boundary of the lot, significantly decreasing the size of the yard. The discrepancy was due to a mistaken assumption by Waldman about the zoning regulations. Richard brought suit against Waldman. The trial court found in favor of Richard. Waldman appealed.
