Facts
Desiree Ridgell (plaintiff) was a teacher’s assistant at the public school where Connor McDermott was a student. On April 26, 2011, Connor wrestled Ridgell to the ground and held her down. After school staff attempted to restrain Connor and Ridgell tried to get off the floor, Connor kicked Ridgell in the head. Ridgell fell backward and struck the back of her head on a desk, and she suffered from numerous physical injuries as a direct result of Connor’s attack. Ridgell filed a complaint against Connor’s parents, Mark and Karen McDermott (defendants), alleging the McDermotts negligently failed to supervise and control Connor. The trial court dismissed Ridgell’s complaint, and Ridgell appealed.
