Rivas v. Oxon Hill Joint Venture
Maryland Court of Special Appeals
744 A. 2d 1076, 130 Md. App. 101 (2000)
- Written by Josh Lee, JD
Facts
Jaime Rivas (plaintiff) was a deputy sheriff for Prince George’s County. Rivas went to the Oxon Hill Village Apartments to serve a witness subpoena and slipped and fell on ice while walking in the parking lot. Rivas sued Oxon Hill Joint Venture, which owned the apartment complex, and Southern Management Corporation, the managing agent (defendants). Rivas alleged that he was an invitee and that the defendants were negligent by not keeping the premises reasonably safe. The defendants moved for summary judgment, arguing that Rivas’s claim was barred by the common-law Fireman’s Rule. The trial court granted the motion, and Rivas appealed.
