Facts
Eleven-year-old Cheryl Rousey suffered injuries in a car accident with her mother, Doris Rousey (defendant), driving. Her father, Smith Rousey (plaintiff), sued his wife on Cheryl’s behalf. Doris’s insurance company moved for summary judgment, asserting Doris held parental immunity. The trial court granted summary judgment, and Mr. Rousey appealed.
