Ryan v. Ryan
Texas Court of Appeals
626 S.W.2d 103 (1981)
- Written by Whitney Kamerzel , JD
Facts
Donald Ryan (defendant) and Phyllis Ryan (plaintiff) were married and subsequently divorced. Donald was employed for 22 years, and his employer provided him with a pension and retirement plan. After the Ryans’ divorce, Phyllis sued to partition Donald’s retirement benefits. The trial court awarded Phyllis a share of the benefits. Donald appealed, arguing that the Employee Retirement Income Security Act (ERISA) preempted state-law community-property rules and prohibited the distribution of retirement benefits.
