Facts
Salevan (plaintiff) was walking by a baseball field when she was hit and injured by a ball. Salevan brought suit against Wilmington Park, Inc. (Wilmington Park) (defendant), the owner of the baseball field. Although Wilmington Park took some precautions to prevent baseballs from flying out the park, testimony showed that on average 16 to 18 balls were hit out of the park in a game.
