Sharp v. Roskelley
Utah Supreme Court
818 P.2d 4 (1991)
- Written by Mary Katherine Cunningham, JD
Facts
Drew Sharp (plaintiff) and Abbie Sharp married in 1977. In 1984, Abbie Sharp went to work for Maurice Roskelley (defendant) as a physician’s assistant. In April 1985, Abbie Sharp entered treatment for alcoholism, and Roskelley paid for her treatment. After leaving treatment, Abbie Sharp and Roskelley began a social relationship that evolved into a sexual relationship. In July 1985, Abbie Sharp asked Drew Sharp to leave the family home, and Drew Sharp was granted a divorce decree on December 26, 1986. During the divorce proceedings, Drew Sharp filed a lawsuit against Roskelley to recover damages for his alleged alienation of and criminal conversation with Abbie Sharp. The trial court granted a summary judgment for Roskelley, finding that Roskelley was not the controlling factor of Drew Sharp’s loss of Abbie Sharp’s affection. The trial court granted summary judgment in favor of Roskelley, and Sharp appealed.
