Facts
Shea (plaintiff) sued Galaxie Lumber & Construction Company, Ltd. (Galaxie) (defendant) for unpaid overtime and retaliation claims under the Fair Labor Standards Act (FLSA) and sexual harassment under Title VII of the Civil Rights Act of 1964 (Title VII). Before trial, Galaxie made a Rule 68 offer to settle Shea’s overtime claim for $3,000, to which Shea failed to respond. The jury returned a verdict for Shea on both claims. The court awarded Shea $1,207 on the overtime claim and set aside the punitive damages on the FLSA claim. Shea moved for attorney’s fees, and the court calculated the potential fee award to be $104,207.50. Based on Shea’s limited success at trial, the court adjusted the amount by 80 percent to $20,841.50. In total, Shea was awarded $23,484. Shea appealed the attorney’s fee decision and the refusal to grant liquidated damages on her FLSA claim. The court of appeals ruled that liquidated damages should have been granted in the amount of $2,415, vacated the court’s decision on attorney’s fees, and remanded the case.
