Facts
Francis Sheehan (plaintiff) sued Roche Brothers Supermarkets, Inc. (defendant) store for negligence after slipping and falling on a grape. Applying a traditional approach, the trial court ruled that the store could not be liable without actual or constructive notice of the condition (the grape on the floor) that caused the slip and fall. Sheehan appealed, urging the court to apply a more modern standard.
