Facts
Shalene Shimer (plaintiff) was a student at Bowling Green State University (defendant). Shimer participated as a member of the chorus in a university theatre production. At the end of the performance, Shimer was required to help disassemble the set. While working to help disassemble the set, Shimer was injured when she fell backward into the orchestra pit below the stage. Shimer filed a negligence action against the university, arguing that the orchestra pit should have been covered to prevent injuries.
