Facts
During World War II, the United States dropped atomic bombs on Hiroshima and Nagasaki. After the war, Shimoda (plaintiff) sued the Japanese government for damages caused to Shimoda by the dropping of the bombs. The dropping of the bombs violated international law because of the vast amount of civilian casualties, horrible wounds, and general destruction caused by the bombs. In its defense, the government noted that Japan had waived all claims of Japan and its nationals against the Allied Forces in the peace treaty that ended the war.
